in a deadly crime spree in san jose. 26-year-old jonathan wilbanks was caught friday night after a series of robberies, police chase and shooting and a carjacking attempt that left one man dead. >> about 9:00 i hear a -- not continuous gunshots but maybe a little one after another. >> saw the victim's father up in the front and she was still in shock finding out that the son had been shot in front of the 7-eleven. >> police say wilbanks' alleged accomplice got away and is still on the run. the reward money is being offered for information that leads to his arrest. >>> menlo park police are looking for suspects in the city's second murder this year. 42-year-old man shot to death saturday night as he sat in a car with a woman in the 300 block of ivy drive. police say the suspects took the woman's purse and ran in separate directions. it's the third shooting this month in menlo park's bell haven neighborhood. >>> a new apology from the bishop of san jose. that's after a registered sex offender was allowed to volunteer at a school festival and now the church and the sheriff's office are tryin

on this day in 2009 gathered tonight in san jose. they wanted to remember him and to demand a trial. nbc bay area's kimberly tere is at frost elementary school with a look at where the case stands now. >> reporter: blocks from where the killing happened and despite arrests made three years ago, the case is yet to go to trial. >> we want justice for michael. that's what he serves and that's what we are here for. as a family, we're not going to stop fighting for that. michael deserves it and we are going to get it. >> reporter: michael russell's family hosted a vigil at this elementary school the last three years. on november 10th, 2009, he was stabbed to death in the backyard of his home. >> i remember it like it happened yesterday. >> reporter: soon after the killing, police arrested two suspects in the case, both classmates of the victim. randy thompson 16 and jay williams 15 at the time of the killing and both are charged as adults. while the hearing was two with years ago, the trial is yet to begin because of numerous continuances. >> we want to do whatever we can to push this forward. >>
. >> thank you. >>> families in san jose are shocked to find out about a registered sex offender who was volunteering at their school. >> cbs 5 reporter cate caugiran explains the twist that may have allowed him to be on campus. >> i put my daughter in this school expecting her to be protected. >> reporter: parents at saint francis cabrini are outraged that a sex offender was at a school event a month ago for the first time. in early october this man 51- year-old mark gurries was volunteering it the elementary festival when someone recognized him as a sex offender and told sheriff's deputies. he told the sheriff's office he had legal permission to be there in the form of a letter from a church official. >> i can't believe he was allowed on campus. >> reporter: that's the question. who signed this so-called form and is it legitimate? >> we want to make sure that the person who signed it exists and give mr.guris permission to be on school ground. >> reporter: parents are still waiting for answers. deputies say gurries has been cooperative. >> we're waiting confirmation by church offici

now the roads are in the bay area and traffic looks good here so far. moving to san jose that traffic looks good getting to highway 17, it is light there are not many problems but there are a few as you just saw and it is a light commute getting into the city. let's go to steve. >> the rain seeps to be falling apart here and north of that. this morning's rain was done with this. rainfall totals for some and they had 1.50. there is not enough of a breeze to wipe this out. there is a little wave with a bend in the clouds as it comes in. it slows down and it keeps cloud cover coming in even though it is moving away from its parent source. it shows not a lot of rain in there but a lot of fog. we will be dealing with some of that thick fog and the nights are getting much longer and after that the weekend looks short. we will have a slow process he have clearing out and radar is still picking up some light rain very mild temperatures on the afternoon highs and we have a sunny break upper 60s to near 78 degrees. fog will be back nice and dreary and don't forget to set your clocks become a. >

showing up about 70 degrees in concord. 70 in san francisco. and 72 in san jose. this is about as good as it gets though this week. we have some rain on the horizon. we'll talk more about that in a moment. right now let's check the roads with elizabeth. >> we are going to enjoy this dry commute while we can. we are following a couple of problems though. we are seeing in the usual amount of delays right -- an unusual amount of delays right now on westbound 4 because of an accident not even blocking lanes. it's off to the shoulder approaching a street lone tree way but unfortunately it's causing heavy traffic right now through antioch. also reports of an accident westbound 580 approaching santa rita, tassajara. we can't see it but we are seeing bunching up but we have delays stop and go from the altamont pass to the dublin interchange. the nimitz 880 through oakland near the oakland coliseum, no problems. 16 minutes between 238 and the maze. and a quick note for the south bay commute in san jose, they have closed off that off-ramp from southbound 880 to the alameda for emergency roadwork
into the san jose area. they stay dry for the better part of halloween but they are getting soaked. on the back side of the cold front we'll see a little bit of sunshine, partly cloudy skies into the afternoon but some drier weather as we head toward the latter part of the day. overlook the city of san francisco, showers out there, as well. temperatures in the 50s and 60s. looks like we have some warmer days ahead. in fact, maybe a return to 80s. wouldn't that be nice? >> it would be nice. especially after a rainy halloween night. here's a live look outside. we are dealing with slick conditions. we have accidents and flooding this morning. a live look at the golden gate bridge. just a lonely headlight towards doyle drive into san francisco. so no major delays. we are watching an accident just coming in from our chp reports. westbound 580 right approaching north first. so just a heads up, possibly blocking lanes. in the meantime drive time 14, 15 minutes through the altamont pass and heading towards the dublin interchange. more slick surfaces. this is out in the east bay, the nimitz, 880 in oakl
south now through san jose so you're seeing a lot of showers in the area, pockets of some moderate amounts of rainfall and a lot of strong gusty winds to go along with that. embedded in the system are cells that are producing moderate amounts of rainfall even some heavy rainfall as you move through. some reports now already over 6, 7" of rainfall in some parts of the north bay and still more to come. you can see this band that's making its way through the bay area now and some heavier cells as we take you in for a closer look. toward mill valley heavy rainfall in the area along 101 if you are traveling along here expect heavy rainfall and the possibility of some flooding now. a lot of that water is ending up in some of the basins now so we're likely to see some flooding in the creeks and streams. flash flood watches are up for the bay area and high wind advisories. we are not done. we'll see the storm system working through the bay area so, yes, the commute is going to be very dangerous, very treacherous. watch out for debris in the roads. of course, some ponding water, as well. we
further to the south right now towards san jose. that line off the coastline is still developing. that's going to be moving onshore going to bring another band of some heavy rainfall on the way. still the san jose area catching the brunt of it right now in through the santa cruz mountains. and urban and small stream flood advisories have just been issued for the santa cruz county area as we are expecting some strong storms to bring more heavy rainfall there and the possibility of some flooding. in towards san francisco, south san francisco, you have a band of heavy rainfall making its way along the 280 an 101. watch out for that. in the east bay strong storms there, near concord another cell moving in your direction. watch out, danville! in the next five five to 10 minutes it's going to start raining heavily here. the damage is done. we have see a tremendous amount of rainfall and flooding in petaluma along the creek there penngrove, expected to flood this morning. flood warnings are up there. we could see more of that on the way not only today but into the weekend as we have mor

and you can see on doppler radar lots of yellow out there. san jose it is seeing some showers right now, some heavier rain earlier. that's soon going to be picking up. you can see north in sunnyvale that we have some stronger storms that will be sliding in your direction. so if you are heading out be careful. we have the rain and some pockets of heavy rainfall into oakland, stretching across the bay into south san francisco. a little further to the north we can see the back side of the storm system. we mentioned the possibility of flooding in petaluma. they are seeing very heavy downpours right now. expecting some flooding along the penngrove stream there. so that's expected to rise as more of that water comes down the hill so some very stormy weather there. mill valley a strong cell headed there. flash flood watches up for much of the bay area. they have been extended for the weekend. we have a lot more rain to come. we'll have more on that coming up in just a few minutes. >> if you can leave later for your morning commute, gosh, it is just a mess in a lot of spots all across the bay a
